THE NOT YOU™ Terms of Use

By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 16 years old to use the general-audience Services unless a different minimum age applies where you live. If you are not legally able to enter into a binding agreement, you may use the Services only with the involvement and permission of a parent or legal guardian as permitted by law.

THE NOT YOU™ provides guided audio, self-reflection, awareness and attention practices, progress features, wellness modules, and related educational content. Features may include Daily Mind Detox, Addiction Breaker, Guilt Cleanser, Anger Tamer, The Antidote, Restful Mind, Mind Clutter Crematorium, Blind Forgiveness, Trauma Trigger, Emergency Mind Detox, Mind Clarity Index™, and future features.

The Services are designed to support personal reflection and mindful awareness. They are not designed to diagnose, prevent, cure, mitigate, or treat any disease or mental-health condition.

Some features may require an account. You are responsible for providing accurate information, protecting your credentials, and maintaining the security of your account. Notify us promptly if you believe your account has been accessed without authorization. You may be required to reauthenticate for sensitive actions such as account deletion.

Subject to these Terms, Mind Clarity Works LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for lawful, non-commercial personal use. No ownership interest is transferred to you.

The Services may offer free access, paid subscriptions, promotional trials, or other entitlement models. Prices, subscription periods, trial terms, and included features will be displayed before purchase where required. Unless cancelled, recurring subscriptions may renew automatically according to the applicable store terms.

We may change subscription offerings or pricing prospectively. Where required, you will receive notice through the applicable platform or Service.

Mobile purchases are processed by Apple through In-App Purchase or by Google through Google Play Billing. Apple and Google are independent providers. Their payment, refund, cancellation, tax, and subscription-management terms may apply in addition to these Terms.

Mind Clarity Works LLC does not directly receive or store full payment-card credentials for in-app purchases.

You may stop using the Services at any time. Account deletion is available through the App where the feature is available and through the account-deletion resource on thenotyou.com.

Deleting the App or your account does not cancel an active recurring Apple App Store or Google Play subscription. You must cancel through the applicable store. Refund eligibility is governed by applicable law and the policies of the platform that processed the purchase.

• Use the Services lawfully and for their intended purpose.
• Keep account information reasonably accurate and protect access credentials.
• Use your own judgment when deciding whether a practice is appropriate for you.
• Stop using a practice and seek appropriate help if you experience distress, worsening symptoms, or an emergency.

• Do not misuse, disrupt, damage, overload, probe, or interfere with the Services or security controls.
• Do not reverse engineer, decompile, scrape, copy, distribute, resell, or commercially exploit the Services except where law expressly permits.
• Do not impersonate another person, use another person’s account without permission, or attempt unauthorized access.
• Do not upload malicious code, use automated systems to abuse the Services, or use the Services for unlawful, fraudulent, harmful, or infringing activity.
• Do not remove copyright, trademark, or proprietary notices.

You may choose to provide assessment responses, preferences, progress information, support communications, or other inputs. You are responsible for information you choose to provide and should not submit medical records, clinical diagnoses, psychotherapy notes, emergency medical information, or other information you do not want processed.

Our handling of personal information is described in the Privacy Policy.

The Mind Clarity Index™ is a guided self-reflection tool concerning thought-loop frequency, identification with thoughts, and disengagement ability. It is not a diagnostic test, clinical assessment, medical score, or measure of personal worth. Results can vary over time and with circumstances.

THE NOT YOU™, Mind Clarity Index™, associated names, logos, audio, scripts, text, designs, illustrations, software, interfaces, and other content are protected by intellectual-property laws and are owned by or licensed to Mind Clarity Works LLC. Except for the limited license above, no rights are granted.

If you voluntarily provide feedback, ideas, suggestions, or improvement requests, you grant Mind Clarity Works LLC permission to use that feedback to improve, operate, and develop the Services without compensation or obligation to you, provided we do not publicly identify you without permission.

The Services may use or link to third-party services, including Apple, Google, authentication providers, app stores, infrastructure providers, and websites. Those third parties operate under their own terms and privacy practices. We are not responsible for independent third-party services.

We may add, modify, suspend, or discontinue features, content, session availability, or technical functionality. We do not guarantee that every feature will always be available on every device, operating system, country, or subscription tier. We may perform maintenance or make changes for security, legal, technical, or product reasons.

Our Privacy Policy explains how Mind Clarity Works LLC handles personal information and is incorporated by reference into these Terms to the extent applicable. Privacy rights and account/data-deletion options are available through the App and thenotyou.com.

THE NOT YOU™ is an educational self-help, mindfulness, and personal-development service. It does not provide medical, psychiatric, psychological, therapeutic, clinical, crisis, or emergency diagnosis, advice, treatment, monitoring, or intervention.

The Services are not a substitute for care from a qualified professional. If you believe you or another person is in immediate danger, contact local emergency services or an appropriate qualified crisis resource in your jurisdiction.

Use of the Services does not create a doctor-patient, therapist-client, psychologist-patient, counselor-client, fiduciary, or other licensed professional relationship with Mind Clarity Works LLC, its personnel, contractors, content contributors, or service providers.

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, secure, or suitable for every person or purpose, or that any particular outcome will result from use.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the maximum extent permitted by law, Mind Clarity Works LLC and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to the Services.

Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount you paid to Mind Clarity Works LLC for the Services during the twelve months before the event giving rise to the claim or USD $100, except where a different limitation is required by applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless Mind Clarity Works LLC and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law rules, except to the extent mandatory consumer law in your place of residence applies.

Before filing a formal claim, you and Mind Clarity Works LLC agree to make a reasonable good-faith effort to resolve the dispute informally by contacting the other party. Nothing in this section limits rights that cannot legally be waived, including access to small-claims court or consumer-protection remedies where applicable.

We may update these Terms as the Services, business, technology, or law changes. We will post the updated Terms and revise the Last Updated date. Where a change is material, we will provide additional notice if required. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.

We may suspend or terminate access if reasonably necessary to protect security, prevent abuse, comply with law, enforce these Terms, or address material violations. You may stop using the Services at any time. Provisions that by their nature should survive termination—including intellectual-property, disclaimers, liability limits, dispute provisions, and accrued rights—will survive.
